Terms of Use and Sale

1. General provisions
These Terms of Use and Sale of Products ("Terms") govern the use of the PEPS Market website, related digital services including the Telegram Mini App, and the procedure for placing and fulfilling orders for PEPS Market products.
By using the site, the Telegram Mini App, or placing an order, the user confirms that they have read these Terms.
If the user does not agree with the Terms, they must stop using the site and not place an order.
These Terms apply to the extent they do not conflict with the mandatory rules of the legislation of the Republic of Uzbekistan.

3. Intended use of products
Unless expressly stated otherwise in the documentation for a specific product, PEPS Market products labeled as research products are intended solely for laboratory, scientific research, analytical, and other lawful research purposes.
Research products are not intended for human consumption, administration to a human or animal, self-treatment, diagnosis, prevention or treatment of disease, or cosmetic or food use.
PEPS Market does not provide medical services and does not give individual medical advice.
Any descriptions of a substance's properties, publications, scientific materials, links to research, and examples of potential effects are provided solely in an informational/research context and are not a guarantee of the outcome, efficacy, or safety of a product when used by a human or animal.
4. Age and confirmation of information
Only persons who are 18 years of age or older and have the necessary legal capacity may place orders.
By placing an order, the buyer confirms that they are at least 18 years old, that the information they provide is accurate, that the purpose of the purchase is lawful, and that they hold any necessary permits, where required by law.
The seller may request additional information or documents to verify age, identity, the legality of the transaction, or compliance with mandatory requirements.
5. Product information
Before a contract is concluded, the buyer is provided with the information about the product and the conditions of its purchase required by law.
Depending on the product, such information may include its name, characteristics, manufacturer and/or supplier, origin, batch number, manufacturing date, expiry date, storage and transport conditions, price, payment terms, delivery, and available quality documents.
Photographs and other visual materials may be illustrative in nature unless expressly stated otherwise.
6. Legal status of products
Stating a research purpose is a description of the product's intended use and does not by itself change its legal classification.
If a substance, component, product, or a transaction involving it falls under products subject to restricted or special circulation, the seller carries out the transaction only within the limits permitted by law and where the required documents are available.
7. Catalog and offer
The materials on the site may be changed, supplemented, and updated.
Listing a product in the catalog does not by itself mean that availability is guaranteed until availability is confirmed by the seller.
The price, availability, quantity, payment method, delivery timeframe and cost, and other material terms of a specific order are communicated to the buyer before it is confirmed.
8. Placing an order
An order is placed through the Telegram Mini App or another official channel expressly designated by the seller.
Before confirming an order, the buyer has access to information about the product and the material terms of the transaction to the extent required by law.
A message, request, or adding a product to the cart does not by itself constitute unconditional confirmation that a contract has been concluded, unless the seller has confirmed the order in the established manner.
An order is deemed accepted for fulfillment once it has been confirmed by the seller.
Order details, correspondence, electronic messages, confirmations, payment documents, and other electronic records may be retained for contract performance and the protection of rights and legitimate interests.
9. Refusal to accept or fulfill an order
The seller may decline to accept or fulfill an order where necessary for compliance with the law, safety requirements, or the documented intended use of the product.
Grounds may include, among others, unavailability of the product, an evident technical error in the price or characteristics, inability to confirm necessary information, a risk of unlawful use or circulation of the product, the absence of mandatory documents, or the impossibility of lawful delivery.
If funds were received before such a circumstance arose, their refund is handled in accordance with applicable law and the terms of the specific transaction.
10. Price and payment
The final price of a product and any additional costs are communicated to the buyer before the order is confirmed.
Payment may be made using a method available at checkout, including cashless payment and, where offered by the seller, cash.
The buyer is provided with a payment document in the cases and manner provided for by law.
11. Delivery and receipt
Delivery is carried out within the territory of the Republic of Uzbekistan, to the extent available for a specific order.
The buyer must provide accurate contact and delivery information.
Upon receipt, it is recommended to check that the order matches, the quantity, the integrity of the packaging, any visible damage, and the labeling.
12. Storage and handling after delivery
After a product has been delivered, the buyer must comply with the storage, transport, and handling conditions indicated on the packaging or in the documentation.
The seller is not liable for quality deterioration caused by the buyer's violation of the established storage, transport, or handling conditions after the product has been delivered, to the extent such liability is not imposed on the seller by law.
13. Returns, replacement, and complaints
Nothing in these Terms cancels or limits the buyer's mandatory rights provided by the legislation of the Republic of Uzbekistan.
Requests for a return, replacement, remedy of defects, compensation for losses, and other claims are reviewed in the manner and within the timeframes established by law and the applicable contract.
To process a complaint, the buyer is advised to provide the order number, purchase date, product, batch number, a description of the circumstances, photographs of the packaging and product, proof of payment, and other information relevant to the complaint.
14. Seller's liability
PEPS Market is liable for violations of mandatory legal requirements to the extent established by law.
To the maximum extent permitted by law, the seller is not liable for consequences arising solely from use of a product other than as stated, violation of storage or transport conditions after delivery, alteration of the product by the buyer or third parties, or unlawful transfer of the product to third parties.
To the extent permitted by law, the seller is not liable for indirect losses, lost profits, or a failure to achieve an expected research result.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
15. Buyer's liability
The buyer is responsible for the accuracy of the information provided and the legality of their actions with the product, to the extent established by law.
When reselling or transferring a product to third parties, the buyer must not misrepresent its intended use, characteristics, or status.
16. Intellectual property
The site, its software interface, design, texts, photographs, logos, and other PEPS Market materials are protected by applicable law.
17. Electronic communications and records
Communication about an order may take place through the site, the Telegram Mini App, Telegram, phone, e-mail, and other official channels.
The seller may retain order information, messages, documents, confirmations, payment and delivery data, and customer inquiries for as long and to the extent necessary to perform contracts, for accounting, for the protection of rights, and for compliance with the law.
18. Personal data
Personal data is processed in accordance with PEPS Market's separate Privacy Policy and applicable legislation of the Republic of Uzbekistan.
Disclosure of data to payment organizations, courier services, IT contractors, and other parties is permitted only to the extent necessary and on a lawful basis.
19. Force majeure
The seller is not liable for delay or failure to perform obligations due to force majeure circumstances, in the cases and to the extent established by law.
20. Changes to the Terms
The seller may amend these Terms for future orders. The new version takes effect from the publication date indicated in it.
An already-concluded contract is governed by the terms in effect at the time it was concluded, unless otherwise provided by the contract or by law.
21. Dispute resolution and governing law
These Terms are governed by the legislation of the Republic of Uzbekistan, unless otherwise established by mandatory rules of applicable law.
The parties will first seek to resolve a dispute by contacting support and submitting a complaint.
Disputes are heard by the competent courts in accordance with the jurisdiction established by law.
22. Severability
If a particular provision is found invalid or unenforceable, the remaining provisions remain in effect to the extent permitted by law.
23. Buyer's confirmation
Before confirming an order, the buyer confirms that they are 18 years of age or older, that the information provided is accurate, that they have reviewed the intended use of the specific product, that they understand its research nature, that they intend to use the product lawfully, and that they have reviewed the material terms of the transaction available before the order.
This confirmation does not deprive the buyer of any rights they cannot waive under the law.
